    KENMORE-TOWN OF TONAWANDA SAFE AND DRUG FREE ZERO TOLERANCE POLICY

    FOR TOBACCO, ALCOHOL, AND OTHER DRUGS

    The Safe and Drug Free School Zone encompasses a 1,000-foot radius

    (approx. 1/4 mile) from the school property.
     

    Section 1

    The following disciplinary actions will occur if a student is consuming, sharing and/or selling, using and/or in possession of illegal drugs, drug paraphernalia and/or endangers the safety of others while using alcohol in the Safe and Drug Free School Zone or at school-sponsored events:
     

    Students Under Age 16

    1. If suspicion of “under the influence”, student is referred to the school nurse

    2. Parents are called to school

    3. Police are called to school

    4. Item is confiscated and turned over to the Police for testing

    5. Police will determine which Court will hear the case

    6. School discipline will be given:

    a. Student is suspended for 5 days

    b. A district disciplinary hearing will be held with an impartial hearing officer

    c. Depending upon the seriousness of the offense, a longer suspension from school may occur

    * Student will be referred to the student assistance team, which will connect them with community resources for assistance and treatment.
     

    Student Age 16 or Over

    1. If suspicion of “under the influence”, student is referred to the school nurse

    2. Police are called to the school

    3. Parents are called to the school

    4. Student is arrested, handcuffed and charged with a crime as an adult

    5. Item is confiscated and turned over to the Police for testing

    6. School discipline is given:

    a. Student is suspended for 5 days

    b. A district disciplinary hearing will be held with an impartial hearing officer

    c. Depending upon the seriousness of the offense, a longer suspension from school may occur

    7. Student will be referred to the student assistance team, which will connect the student and family with community resources for assistance and treatment.
     

    Section 2

    The following disciplinary actions will occur if a student is consuming, sharing, selling, and/or in possession of alcohol in the Safe and Drug Free School Zone or at a school-sponsored event:

    1. If suspicion of “under the influence”, student is referred to the school nurse

    2. Parents are called to school

    3. School discipline will be given

    a. Student is suspended for 5 days

    b. A district disciplinary hearing will be called with an impartial hearing officer

    c. Depending upon the seriousness of the offense, a longer suspension from school may occur

    *Student will be referred to the student assistance team, which will connect the student and family with community resources for assistance and treatment.
     

    Section 3

    The following disciplinary actions will occur if a student is using, sharing, or possessing tobacco in the Safe and Drug Free School Zone or at a school-sponsored event:

    1. School discipline will be given:

    a. Student is suspended for one day

    b. Parents are called

    c. A more serious suspension will occur if offense is repeated in the future

    Again, the SAFE AND DRUG FREE SCHOOL ZONE encompasses a 1,000-foot radius (approx. 1/4 mile) from the school property. Administrators, Teachers, Support Staff, Security and Police will enforce the zone.

     
     
     

    Fighting

     

        

    KENMORE EAST HIGH SCHOOL ZERO TOLERANCE POLICY FOR FIGHTING

     

         The goal of the Zero Tolerance Policy for Violence is to ensure an effective and safe school for every student at Kenmore East High School.  Under this policy every student has the right to go to and from school and participate in their education and/or extra-curricular activities without being threatened, intimidated, physically attacked or hassled in any way.  This anti-violence policy is designed to make Kenmore East a safe place for learning.

     

          In every potentially violent situation the goal will be to de-escalate the emotions involved.  For this to occur school staff will enforce consistent school-wide rules that are clear, broad-based and fair.  Under this policy, the school will not tolerate having any student’s basic rights or safety threatened.  In addition, the school will not tolerate using violence/fighting as a solution to solve problems.

     

    Students will be in violation of the zero tolerance for fighting policy if they have committed an act that:

    1.  Caused, attempted to cause, or instigated a physical injury.  Pushing and shoving are classified in this category since they lead to fighting, and are a violation of the anti-violence policy.
     
    Consequence:

    *Students who are engaged in a physical

    altercation could receive up to a five day   out of school suspension.

    *Parents notified

    *Police may be called to investigate the fight, depending on the severity of the incident

    *Police report may be filed, depending on  the severity of the incident

     

    2. Willfully used force or violence upon the person of another including willfully choosing to respond.  Non-aggressive self-defense allows you to defend yourself against an attack, but only to the point where an attacker backs off.  Aggressive self-defense constitutes participating in an altercation.

     

    Consequence:

    *Five day out of school suspension

                    *Parents notified

                    *Police will be called to investigate the fight

                    *Police report will be filed

     

    Readmission to school after a fight:

     

        Students who are suspended will be required to participate in a readmission conference with their administrator and school counselor.  Parent(s) will be required to attend.  A behavior management contract will be written during the conference, with clear expectations of student behavior.  Outside counseling will be recommended if it is deemed necessary.  Continued violent behavior could result in an alternative school placement.           

     
     
     

    Weapons

      

    KENMORE EAST HIGH SCHOOL ZERO TOLERANCE POLICY FOR WEAPONS

    I shall be unlawful for any person to knowingly possess any gun or other instrument or weapon as defined in Federal and State law on school grounds. Unlawful possession of a weapon upon school grounds may be a violation of the New York State Penal law, and is a violation of the District Policy on School Conduct and Discipline.

    In the case of weapons possession, any school personnel may notify the police as this is considered an emergency in all cases.
     

    Students will be in violation of the zero tolerance for weapons policy if they are in the possession of illegal weapons including:
     

    · Deadly Weapons - any loaded weapon from

    which a shot capable of producing serious injury or death may be discharged, i.e. rifle, shotgun, handgun, imitation pistol, pellet gun, BB gun

    · Also - switchblade knife, gravity knife, ballistic

    knife, dagger, billy, blackjack, or metal knuckles

    · Dangerous Instruments - any instrument,article or

    substance, including a vehicle which, under the circumstances in which it is used, attempted to be used or threatened to be used, is capable of causing death or other serious injury

    · Possession of any dagger, dangerous knife, dirk,

    razor, stiletto, or any other dangerous or deadly instrument or weapon with intent to use unlawfully against another.

    · Possession of pepper spray
     

    Students Under Age 16

    1. Referral to the appropriate agency or authority for a juvenile delinquency proceeding in accordance with Article 3 of the Family Court Act.

    2. After a Superintendent's hearing, the student shall be suspended for a period of no less than one calendar year.

    3. After the imposition of the one-year penalty, the Superintendent has the authority to modify this suspension requirement for each student on a case-by-case basis.
     

    Students Age 16 or Over

    1. Referral to the appropriate law enforcement officials

    2. After a Superintendent's hearing, the student shall be suspended for a period of not less than one calendar year

    3. After the imposition of the one-year penalty, the Superintendent has the authority to modify this suspension requirement for each student on a case-by-case basis.
